Abstract
This is a Memorandum of Advice from the Commissioner for Children to the Minister of Health and Human Services in Tasmania with regard to family violence and refugee and migrant issues of concern. It refers to children from migrant and refugee communities as having experienced trauma in different ways, from conflict in their country of origin, as a result of their journey to Australia or detention. In order to help address the emotional and psychological distress, migrant and refugee families need to have sufficient services to address their difficulties early. They also need information on the protection of criminal law from violence and culturally specific support services. New migrants and refugees need special assistance to understand the position of Tasmania Police with regard to the prosecution of family violence, irrespective of what culture the offender may belong to. An outline of relevant legislative provisions in Tasmania with regard to assault, and guidelines on police prosecution discretion, is given. Recommendations include that information be available to migrants and refugees in their first languages, regarding the existing Tasmania Police position on family violence, existing legislation on assault, and proposed legislation on family violence. Refuges and shelters are also recommended to have culturally appropriate services.
